FAQ

5.01 Plan Approval Requirements:
No improvement, change, (including, without limitation, change in exterior color) construction, addition, excavation, landscaping, fencing, tree removal, or other work action which in any way alters the exterior appearance of the PROPERTY from its therefore natural or improved state (and no change altering or other modification of any of the foregoing previously approved hereunder), and no addition to or modification of any improvement or landscaping (whether or not theretofore approved hereunder) shall be commenced or continued until the same shall have first been approved in writing by the ASSOCIATION acting through the BOARD, except that the BOARD shall have the right to appoint the DECLARANT or a separate board to perform the review function. Any such review board shall act at the discretion of, and be replaceable at the will of the BOARD.

6.07 Animal Maintenance:
No animals shall be raised, bred, or kept on any LOT or in the COMMON AREA except that common household pets, including dogs, cats, birds or fish may be kept on a LOT; provided however, that no animals shall be kept, bred, or maintained for any commercial purpose or in unreasonable numbers as may be determined by the ASSOCIATION from time to time. As used herein, "unreasonable numbers" shall ordinarily mean more than two (2) animals per LOT. Each OWNER shall be responsible for cleaning any excrement or other unclean or unsanitary condition caused by said animal(s) of such OWNER on the LOT, COMMON AREA, or PROPERTY. The ASSOCIATION shall have the right to prohibit maintenance of any animal within the PROPERTY, which in the opinion of the ASSOCIATION, constitutes a private nuisance to any other person. Any person bringing an animal upon or keeping an animal within the confides of the PROPERTY shall be liable pursuant to the laws of the State of Ohio to each and all persons for any injury or damage to persons or property caused by such animal.

6.08 Landscaping:
All landscaping installed on a LOT shall be installed only in accordance with the plans and specifications approved by the BOARD. No alterations, modifications or changes shall be permitted except with permission of the BOARD.

6.11 Electronic Devises:
No appliances or installations on the exterior of any RESIDENCE or accessory structures shall be permitted unless they are designed in such a manner that they are not visible from the streets, other RESIDENCES, and adjoining PROPERTY, and they have been approved in writing by the BOARD, which shall have the right to approve or disapprove the size, shape, style, noise level, and provisions for screening of any roof mounted equipment. Under no circumstances will outside antennas, disks, satellite receivers, aerials, antenna poles, antenna masts, electronic devices, antenna towers, citizen band (CB) or amateur band (HAM) antennas be permitted unless maintained completely inside the RESIDENCE or located in the rear of the yard within two (2) feet of the RESIDENCE such that they cannot be seen from any street or sidewalk and approved by the BOARD. No antenna or tower, either free standing or roof mounted, shall be permitted to extend more than four (4) feet above the ridge lines of the roof of the RESIDENCE upon which or by it is constructed.

6.14 Fences:
No fence, outside wall or hedge shall be situated on any LOT nearer to the front LOT line than the front wall of the RESIDENCE. No fence, outside wall, or hedge may be installed or altered without written BOARD approval. In no event shall a chain link fence be permitted on any part of any LOT.

6.18 Pools:
No above ground swimming pools of any type shall be constructed on any LOT. Pools may not be covered with air inflated covers. The pool location, rigid cover and design must be approved by the BOARD, which approval may be withheld by the BOARD in its sole discretion.
